A Court of Appeal has restored Ademola Adeleke to his position as governor of Osun state.
Recall that the Osun State Governorship Election Petition Tribunal sitting in Osogbo on Friday, January 27 nullified the election of Ademola Adeleke as Osun governor.
A three-judge tribunal headed over by Justice Mohammed Lawal Shuaibu on Friday, March 24, ruled that the candidate for the All Progressives Congress (APC) and former governor Gboyega Oyetola had failed to substantiate claims of overvoting in favor of the People’s Democratic Party. (PDP).
They also pointed out that the electoral panel erred in ruling that Gboyega Oyetola and the All Progressives Congress, the first and second respondents, had established their claim of excessive voting.
In a unanimous decision, the appeal court also fined the APC and its nominee N500,000 in costs.
However, it rejected Adeleke’s argument that there was no prejudice in the governorship election petition panel chairman’s remark that “Go low, low, Buga won.”
